1. Introduction
Welcome to Qikink! These Terms of Service (“Terms”) govern your access to and use of our platform and services, including print-on-demand, order fulfillment, and shipping (collectively, “Services”). By signing up with Qikink.com and using our Services, you agree to comply with and be bound by these Terms.
In these Terms, references to “We,” “Us,” and “Our” refer to Qikink. Please review these Terms carefully. If you have any concerns or do not agree with any part of the Terms, we recommend refraining from using the services.
2. Eligibility & Acceptance of Terms
To use our Services, you must meet the following criteria:
- Age Requirement: You must be at least 18 years old. Suppose you are below 18 years of age. In that case, you may use the Services under the supervision and with the legal consent of a parent or guardian, who will be responsible for entering into binding contracts on your behalf. In all cases, User affirms that User is over the age of 13, as the Qikink is not intended for children under 13. If you are under 13 years of age, then please do not use the Qikink.
- Legal Capability: You must have the legal capacity, either personally or through your parent/guardian, to enter into binding contracts under applicable Indian laws.
- Agreement to Terms: By registering and using the Services, you or your parent/guardian accept and agree to abide by these Terms.
We reserve the right to refuse access to the Services to anyone for any reason at any time.
3. Service Description & Scope
Qikink offers print-on-demand and order fulfillment services to sellers. This includes:
- Custom Product Creation: Sellers upload designs, and we print them on selected products.
- Order Fulfillment: We package and ship products on behalf of sellers to their customers.
- Delivery: We manage delivery through shipping partners as specified in our shipping policies.
These Terms apply to all activities associated with using our platform and Services.
4. Account Registration
To access our Services, you must create an account by providing accurate, up-to-date information.
- Account Responsibility: You are responsible for maintaining the confidentiality of your account information, including your bank details/contact information/password. You agree to notify us immediately if you suspect any unauthorized use of your account.
- Account Suspension: We reserve the right to suspend or terminate your account if we suspect any misuse, fraud, or violation of these Terms.
- Account Creation: In order to access some features of the Qikink, User must create an account. User is not authorized to use another person’s account without their express written permission. When creating a Qikink account, User must provide accurate and complete information. Although Qikink will not be liable for User’s losses caused by any unauthorized use of User’s account, User may be liable for the losses of Qikink or others due to such unauthorized use.
5. Seller Responsibilities
As a seller, you must comply with the following:
- Accuracy of Information: Ensure all the information provided during registration and order placement is correct.
- Print Files: The User is required to provide high-quality, print-ready, sized art. Images are printed at the size they are provided. Qikink is not responsible for low-quality images or incorrectly sized images. Qikink does not alter print images to match mockup files.
- Compliance with Laws: You agree to comply with all relevant local, state, and international laws, including intellectual property and consumer protection laws. It is your responsibility to ensure that the designs and products you sell are legal.
- File Storage: Qikink does not guarantee permanent storage of User files. We reserve the right to delete user files in the case of user inactivity. A User can be considered inactive in the case of, but not limited to, User has not had any sales in three (3) months, User has not logged into their Qikink account in six (6) months.
- Prohibited Content: You may not upload or sell any content that:
- Violates intellectual property rights.
- Promotes hate speech, violence, or illegal activities.
- Includes adult content, explicit imagery, or any designs that depict nudity, sexual content, or suggestive themes.
- Contains offensive, defamatory, or obscene materials.
- Involves any graphic designs that are prohibited by applicable laws or deemed inappropriate for public distribution.
6. Ownership & Intellectual Property
- Seller Content: You retain ownership of the designs and materials you upload to the platform. However, by using our Services, you grant us a non-exclusive, royalty-free license to use, reproduce, and display your designs for the purposes of fulfilling orders, promoting your store, and marketing our Services.
- Qikink Intellectual Property: All content on our platform (e.g., website design, logos, product mockups) is the intellectual property of ”HUEPress” and cannot be used without our prior written permission.
7. Orders & Fulfillment Process
Order Placement: Once your customer places an order on your Qikink linked store/ you places an order on Qikink dashboard, we will handle the production and fulfillment. Orders are processed based on the information you provide.
Order Accuracy: It is your responsibility to ensure the accuracy of the orders, including design placement, size, and shipping details.
Order Confirmation: You will receive an order confirmation when we receive your order. Changes to orders cannot be made once the order is taken for processing.
Fulfillment Timeline: Our standard production time is 1-5 days based on the product & printing options. Shipping times may vary depending on the destination & type of shipping mode you choose while placing an order. Qikink is not responsible for 3rd party delivery delays, lost packages, or damage due to delivery partner.
8. Pricing, Payments, & Billing
Service Pricing: The cost of our services is outlined on the platform and may be updated periodically. You may be notified of any price changes through mail/dashboard notifications.
Payment for goods: All orders must be paid prior to us starting to process your orders. To pay for orders, USERS must make a deposit equal to or greater than the amount owed for orders placed.
Payment Terms: Payments for all orders must be made upfront. We accept Credit/Debit Cards, UPI, Net Banking, Wallet, etc. All transactions are processed in INR (Indian Rupees) unless otherwise specified.
Tax Responsibility: As the seller, you are responsible for all applicable taxes, including GST, duties, and levies on the sale of your products.
9. Shipping & Delivery
We offer a variety of shipping options based on your customer’s location. Shipping rates and delivery times are available in our Shipping Policy.
Domestic Shipping: Orders within India may/may not be delivered within 2-9 days. If any event/natural disaster/other things may stop the shipping partner from delivering the orders to end customers.
International Shipping: Delivery times and costs for international orders vary by location. You are responsible for any duties or taxes levied on international shipments.
Order Tracking: You will receive tracking details for each order once it is shipped. For India Post/Other courier providers may not update their tracking. In such cases, we only adhere to the shipping partners’ final voice.
Shipping Errors: If there are issues with delivery due to incorrect shipping information, you are responsible for additional shipping charges.
10. Returns, Refunds, & Cancellations
Return Policy: Custom products are not eligible for returns unless there is a defect in manufacturing or fulfillment. For more details, please refer to our Return Policy.
Returns: Qikink is not responsible for incorrectly provided addresses that result in lost or misdirected packages. If packages are returned to us for any reason and need to be reshipped there the seller must the cost of the re-shipment. Size exchanges or general returns/exchanges are not the responsibility of Qikink and sellers must resubmit and pay for this type of order.
Refunds: Refunds are only issued in cases of defective products or errors on our part. Please contact our support team within 7 days of delivery with video proof, if you encounter any issues.
Order Cancellations: Once an order is processed, it cannot be canceled. We may cancel orders at our discretion for reasons such as payment failure, violation of these Terms, or suspected fraud.
11. Taxes & GST Compliance
As a seller, you are responsible for ensuring compliance with all applicable tax regulations, including:
GST Collection: You are responsible for collecting and remitting Goods and Services Tax (GST) on sales where applicable.
Tax Tools: We provide tools to help estimate tax liability, but you should consult with a tax advisor for your specific tax situation.
12. Limitation of Liability
No Warranty: We do not guarantee that our Services will be error-free, uninterrupted, or secure. We are not liable for any indirect, incidental, or consequential damages arising from your use of our Services.
Limitation on Damages: Our liability for any claim related to these Terms or the use of our Services will be limited to the amount paid by you to us for the specific order in question.
13. Indemnification
You agree to indemnify and hold “Qikink” harmless from any claims, damages, losses, or legal expenses arising from your violation of these Terms or any third-party rights, including intellectual property and privacy rights.
14. Termination of Services
- Termination by Seller: You may close your account and terminate your use of our Services at any time. Any pending orders or payments must be resolved before the termination takes effect. Pending payment will be transferred to your account/UPI by deducting the payment gateway charges.
- Termination by Qikink: We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse our Services. No refunds shall be made in such cases.
15. Governing Law & Dispute Resolution
Governing Law: These Terms are governed by the laws of India, without regard to its conflict of law provisions.
Dispute Resolution: Any disputes arising from or related to these Terms will be resolved through arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The arbitration will take place in Coimbatore, India, and the decision will be binding on both parties.
16. Privacy & Data Protection
Privacy Policy: Our Privacy Policy outlines how we collect, use, and protect your personal data. By using our Services, you agree to the collection and use of your data as described in our Privacy Policy.
17. Changes to Terms of Service
We reserve the right to modify or update these Terms at any time. Changes will be posted on our website, and your continued use of the Services after changes have been posted constitutes your acceptance of the revised Terms.
18. Force Majeure
We are not responsible for delays or failures to perform due to events outside our reasonable control, including but not limited to natural disasters, strikes, government actions, or technical failures.
19. Warranty Disclaimer:
Qikink, including its officers, directors, employees, affiliates, agents, and business partners, disclaims all warranties, whether express or implied, in connection with the use of the QikInk.com Website and Services.
- Errors or inaccuracies in the content on our website.
- Personal injury or property damage of any kind resulting from your access to or use of our website.
- Unauthorized access to our secure servers and any personal or financial information stored therein.
- Interruptions in transmission to or from our website.
- Bugs, viruses, or malware that may be transmitted to or through our website by third parties.
- Errors or omissions in any content, or any loss or damage arising from the use of any content posted, emailed, or otherwise made available through our website.
Qikink does not warrant, endorse, or take responsibility for any product or service advertised by third parties on our site or through linked websites. We are not responsible for monitoring any transactions between you and third-party providers of products or services.
